Filling in the W-8BEN: the US tax form for creators outside the US

7 min read · Published on 2026-10-26

Short answer

With the W-8BEN you confirm to a US platform or another US payer that you are not a US person. The form does not go to the IRS but to whoever asks for it, and it stays valid until the end of the third calendar year after you sign it. Without it, the payer may withhold up to 30 percent. The money is still taxed where you live.

Anyone earning on several platforms ends up with a US-based one sooner or later – and it asks for this form before the first payout. Some want a signed PDF, others collect the same details in a questionnaire in their payout settings; the fields are identical either way. This article explains what the form does and what goes in each line. It does not replace tax advice.

What the form does

The W-8BEN has two jobs. It shows that you are not a US person. And it is where you claim a reduced rate or an exemption as a resident of a country with a tax treaty, if that applies to you. According to the IRS, when a payer asks for the form you provide it even if you claim no reduction.

Three things that are often misunderstood:

  • It does not go to the IRS. You give it to whoever asks for it, usually the platform that pays you.
  • Each payer needs its own. If you work with two US platforms, you fill it in twice.
  • It belongs before the first payment. The IRS expects the form to be in place before the money is paid or credited to you.

Who needs which form

You are Form
an individual without US citizenship, living outside the US W-8BEN
a company outside the US, for example a German GmbH or a UK limited company W-8BEN-E
a US citizen, even if you live abroad W-9
tax resident in the US, for example with a green card W-9

The third row surprises many people: if you hold a US passport, you do not fill in a W-8BEN, not even while living in Berlin or London. How payouts and forms work for creators in the US is covered in How do US creators get paid?.

Line by line

Line What goes in Common mistake
1 Name your legal name, as on your ID your stage name
2 Country of citizenship the country of your citizenship; with two passports, the country where you are both a citizen and a resident –
3 Permanent residence address your registered home address in your country of residence a PO box, a mailing-only address or a bank's address
4 Mailing address only if it differs from line 3 the same address twice
5 US taxpayer number SSN or ITIN, if you have one entering your home country's number here
6a Foreign tax number the tax number your country of residence issued to you, in Germany the 11-digit tax ID leaving it blank while claiming treaty benefits
6b tick only if your country does not require you to have a tax number ticking it although your country issues one
7 Reference number only if the payer gives you one –
8 Date of birth in the format MM-DD-YYYY, month first day and month swapped
9 Treaty country your country of residence, if you claim benefits under a tax treaty –
10 Special rates only for treaty benefits with conditions line 9 does not cover; if in doubt, with your tax adviser guessing the article and the rate
Part III signature, date, name sent without a date

Two lines deserve a second look. For treaty benefits, the IRS asks for either a US number on line 5 or your home country's tax number on line 6a – so applying for an ITIN just for this is usually unnecessary. And the date of birth follows US order: if you were born on 15 April 1996, you write 04-15-1996, not 15-04-1996.

Your name and address should also match your account with the platform and the bank account you are paid into. If something differs, questions follow quickly and the payout waits – more on how accounts and platforms fit together in International banking for creators.

How long it stays valid

A W-8BEN is valid from the day you sign it until the last day of the third calendar year that follows. The IRS example: signed on 30 September 2015, valid until 31 December 2018. A form you sign in 2026 is therefore valid until the end of 2029.

If something changes before then that makes any of your details wrong, you have to tell the payer within 30 days and provide a new form. Moving within your country, or to another country outside the US, generally does not count as a change. Two exceptions: moving to the US – and, if you claim treaty benefits, moving away from the country whose treaty you rely on. If you are planning to move abroad, put the form on the list.

What happens if it is missing

If you do not provide the form, the IRS says the payer may withhold at the foreign-person rate of 30 percent or at the backup withholding rate. The 30 percent applies to certain income from US sources and is taken from the gross amount, not from your profit.

If anything was withheld, keep the statement showing it, usually Form 1042-S. Whether and how the amount can be credited against tax at home is a question for your tax adviser – it depends on what kind of income it was.

And the tax at home?

The W-8BEN only governs what the US payer withholds. It has nothing to do with the tax where you live: income from US platforms is taxable in Germany, for example, just like any other income. Nothing withheld in the US does not mean nothing to pay. The US has tax treaties with many countries, including Germany, Austria and Switzerland; which benefits follow for which income is a question for an adviser, not for a form field.

What to check before you send it

Step What to look out for
Have your tax number ready in Germany, the tax ID is on your income tax assessment or the letter from the Federal Central Tax Office
Date of birth month first: 04-15-1996 instead of 15.04.1996
Address your registered home address, no PO box
Treaty country line 9: your country of residence
Records save a dated copy and put the expiry date in your calendar

We set up new platforms together with our models, so the first payout does not get stuck on a swapped date. For the tax side we work with tax advisers who know these cases from this business and put you in touch in a first conversation.
